Golf Swing Systems Ltd — Standard Terms & Conditions for Simulator Sales & Installation
- General
These terms and conditions apply to all sales, quotations, and installations provided by Golf Swing Systems Ltd (“GSS”), registered in England and Wales, Company Number 7466356. By accepting a quotation or placing an order, the customer agrees to these terms in full.
- Warranty
- GSS warrants that all installation and integration services will be performed in a professional and workmanlike manner and that supplied materials will be free from defects.
2. This warranty remains in effect for a period of two (2) years from the date of completed installation.
3. The warranty covers supplied hardware and installation workmanship but does not cover:
– Normal wear and tear of impact screens, turf, or padding.
– Travel, labour, or shipping costs relating to replacement of goods under warranty.
– Damage or faults caused by third-party interference, modification, or incorrect use.
4. The warranty does not extend to the TrackMan or other third-party manufacturer’s own hardware, which remains subject to their standard warranty terms.
III. Technical Support and Maintenance
- GSS provides complimentary technical support for one (1) year from the date of installation.
2. After the first year, support and service visits will be available under a paid maintenance agreement, renewable annually.
3. The maintenance agreement may include: routine inspection, system updates, equipment cleaning, and priority service response. - Payment Terms
- Payment is due as follows:
– 70% deposit upon order confirmation.
– 30% balance payable on completion of installation.
2. All payments must be made in GBP to the bank account specified on the quotation or invoice.
3. Late payments may incur interest at 1% per month on any outstanding balance.
4. The customer may not withhold payment due to minor outstanding works or adjustments. - Customer Responsibilities
When ordering a simulator from Golf Swing Systems Ltd, the Customer is responsible for ensuring that all agreed site conditions and preparations are met prior to installation.
During the planning stage:
- The Customer must pay the initial deposit before production of any bespoke components or shipment of goods begins.
- The Customer must provide full and accurate room dimensions and photographs of the installation area.
- The Customer must inform GSS of any features that could affect installation, such as windows, radiators, beams, ventilation, lighting, or ceiling height restrictions.
- Any underfloor heating, unusual wall construction, or ceiling obstructions must be disclosed in advance.
- The Customer is responsible for ensuring all required building works, joinery, and electrical preparation are completed in line with GSS specifications.
- The final design, including measurements and layout, must be confirmed by the Customer at least six weeks before the planned installation date.
- If site information changes after design approval, any resulting additional materials or labour will be chargeable.
Prior to installation:
- The Customer must ensure that clear access to the property and simulator room is available for delivery and installation.
- Parking arrangements, entry procedures, and any delivery restrictions (e.g. stairs, narrow hallways, low ceilings) must be communicated in advance.
- The room must be empty, clean, and free from dust and debris before installation starts.
- Power sockets and internet connections must be live, tested, and positioned according to GSS’s guidance.
- No other contractors may work in the same space during installation.
- The Customer must provide two step ladders suitable for reaching ceiling height; if ceiling height exceeds 3.5 m, scaffolding or a lift must be supplied.
- Adequate lighting must be available for the installers to work safely.
During installation:
- The Customer (or an authorised representative) must be available to provide access and respond to any on-site queries.
- The Customer is responsible for protecting surrounding areas, flooring, and furnishings.
- GSS installers will only fit components supplied by Golf Swing Systems Ltd and will not install third-party items.
- Normal levels of noise and dust are to be expected during installation.
Goods handling:
- The Customer must accept and safely store all delivered goods until installation. Large crates and turf rolls may weigh up to 250 kg and require appropriate handling.
- Packaging should be inspected on arrival; any visible transport damage must be noted on the delivery note and reported immediately to GSS.
- Goods must be stored in a dry, level, and secure area near the intended installation space.
- The Customer is responsible for disposing of packaging and waste materials after installation.
Failure to meet the above conditions may result in additional charges, delays, or the need to reschedule installation. Golf Swing Systems Ltd cannot be held responsible for costs or losses arising from incomplete site readiness or inaccurate information provided by the Customer.
- Delivery and Installation
- Delivery and Risk
The risk of accidental loss or damage to goods passes to the Customer at the time the goods are delivered to the Customer’s address or designated delivery location. The Customer is responsible for accepting and inspecting deliveries and for storing all items in a dry, protected indoor environment until installation takes place. - Storage and Handling
The Customer must ensure the goods are stored flat and protected from moisture, dust, or temperature extremes. Larger items such as turf rolls and crates may weigh up to 250 kg and should be stored safely near the intended installation area. - Site Preparation
The Customer is responsible for ensuring that the installation area is ready prior to the agreed start date. This includes:
- Clear and unobstructed access to the site.
- Completed structural, building, and electrical works in accordance with GSS guidance.
- A clean, dust-free, and empty space with working power and internet connectivity.
- No other trades or contractors present during installation.
- Access and Facilities
The Customer must provide access to the premises during normal working hours and supply information regarding parking, entry, and site safety procedures. Adequate work lighting must be provided. For ceilings higher than 3.5 metres, scaffolding or a lift must be provided by the Customer. - Installation
GSS installers will only install products supplied by Golf Swing Systems Ltd. Installation may involve the use of power tools and will generate a normal level of construction noise. The Customer must protect floors, walls, and nearby furnishings as required. - Inspection and Acceptance
Upon completion of installation, a joint inspection will be conducted by a representative of GSS and the Customer. If no material defects are noted, the installation will be considered complete and accepted. - Title to Goods
Legal title to all goods remains with Golf Swing Systems Ltd until payment has been received in full.
VII. Cancellation Policy
- A £1,000 cancellation fee will apply if the customer cancels the order more than 14 days after placing the order, or within 14 days of the scheduled installation date, whichever occurs first.
2. This is to cover administrative time, project planning, and the purchase of bespoke components.
3. If cancellation occurs before 14 days from placing the order, any non-recoverable costs for bespoke materials may still be charged at GSS’s discretion.
VIII. Liability
- GSS shall not be liable for any indirect or consequential losses, including but not limited to loss of revenue, downtime, or loss of enjoyment of the simulator.
2. GSS’s total aggregate liability shall not exceed the total amount paid by the customer for the goods and services provided.
3. The customer agrees to indemnify GSS and its employees from any injury, damage, or costs resulting from misuse or unauthorised alteration of the installed system. - Rescheduling
If an installation needs to be rescheduled, GSS will make every effort to accommodate the change without penalty. However, rescheduling is subject to installer availability and may extend lead times.
- Governing Law
These terms and all agreements with Golf Swing Systems Ltd are governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
